Слово популярны мы написали не просто так, практически каждое пятнадцатое частное акционерное общество имеет в своем составе кипрских акционеров.

По данным официальной украинской статистики, за 2019 год Кипр занял первое место по прямым инвестициям в Украину с цифрой более 16 миллиардов долларов, что на три миллиарда больше, чем за 2018 год. И составляет одну треть от всех зарубежных инвестиций в нашу экономику. Эта цифра впервые с 2014 года перевалила за 16 миллиардов и приближается к рекордному 2013 году, когда сумма прямых инвестиций в Украину от кипрских компаний была более 17,7 миллиарда. Все прекрасно понимают, что эти деньги были ранее выведены из Украины в виде дивидендов или процентов и сейчас возвращаются домой.Всего в Украине насчитывается больше 6000 предприятий, учредителями которых являются кипрские компании. Так же кипрские юридические лица числятся в составе 30 процентов всех предприятий с иностранным участием и являются самыми популярными местом регистрации среди всех юрисдикций.Чуть менее 1 процента (0,86) от всех украинских обществ с ограниченной ответственностью имеют в своем составе в качестве учредителей кипрскую фирму. Согласитесь – цифры внушительные.История участия кипрских компаний в украинской экономике очень давняя, в далекие девяностые компаниями нерезидентами с успехом пользовались в процессе приватизации. За такими фирмами можно было успешно спрятаться и «не светить» свое участие в приватизационном дерибане. Время идет, роль кипрских компаний сильно изменилась – они перестали быть оффшорами, офшорный режим действовал в этой стране с 1977 по 2003, — за год до вступления в Европейский Союз, изменилось налогообложение, вскоре заработает реестр бенефициаров. Но количество «инвесторов киприотов» не уменьшается. Большая часть украинских компаний, имеющих кипрские корни, ведут бизнес в сфере услуг. Аналитики YouControl проанализировали Единый государственный реестр юридических лиц и физических лиц-предпринимателей и общественных формирований (ЕГР) и определили, что 1986 компаний, имеющих место регистрации своих учредителей на Кипре, работают в сфере недвижимости, 1116 – оптовая и розничная торговля, 32 занимаются оказанием финансовых услуг. Связаны с кипрскими юридическими лицами так же 226 производителей электроэнергии и 209 фирм, занимающихся бизнесом в сфере сельского хозяйства.Раньше использование оффшорной компании позволяло скрыть реального собственника активов, достаточно вспомнить президента Януковича, который на всю страну рассказывал о своих «кипрских соседях» по Межигорью. Сейчас все изменилось, теперь Кипр это все так же «низконалоговая юрисдикция» плюс стабильный и справедливый суд, благодаря применяемой там системе английского права. Времена анонимности прошли, на Кипре вот-вот начнет работать реестр бенефициаров, в Украине вступили в силу правила КИК, однако рейдерство и несправедливое уголовное преследование в нашей стране еще никто не отменил. И что бы обезопасить свой бизнес, предприниматели стремятся использовать «защитную структуру» в виде иностранного юридического лица. Еще одно преимущество Кипрских компаний – они являются резидентами ЕС, т.е. компания, которая может использовать все преимущества членства в Европейском Союзе. Кипр подписал более 90 соглашений об избегании двойного налогообложения и если выплаты дивидендов из Украины с льготной ставкой налога уже в прошлом (правила сабстенс), то с другими странами это еще работает.
